This study presents a comprehensive appraisal of the criminal courts’ jurisdiction in addressing the situation in Ukraine. Focusing on the ongoing conflict since 2014, which escalated into a full-scale war in 2022 following the Russian invasion. The conflict has raised serious concerns regarding violations of international criminal law, including war crimes, crimes against humanity, and potential genocide. The complexity of the situation in Ukraine, involving state actors, non-state actors, and foreign interventions, demands a thorough examination of the roles and limitations of various criminal courts, including Ukrainian national courts, the International Criminal Court (ICC), and other international and regional judicial bodies.

The study begins by analyzing the jurisdiction of Ukraine’s national courts in prosecuting crimes committed during the conflict. Ukrainian criminal law provides for the prosecution of war crimes and other serious offenses under its criminal code, and recent legal reforms have strengthened the capacity of national courts to handle such cases. However, challenges remain in ensuring impartiality, securing evidence in conflict zones, and protecting the rights of both victims and defendants. The study examines landmark cases brought before Ukrainian courts and assesses their impact on the broader accountability framework in the country.

The International Criminal Court (ICC) plays a pivotal role in the appraisal of criminal jurisdiction concerning Ukraine. Although Ukraine is not a state party to the Rome Statute, it has accepted the court’s jurisdiction over crimes committed on its territory since 2014. The study critically assesses the ICC’s ongoing investigations into war crimes and crimes against humanity in Ukraine. It also explores the legal and political challenges the court faces, including issues of state cooperation, the admissibility of cases, and the potential for political interference. The analysis highlights the significance of the ICC’s role in ensuring accountability for the most serious crimes under international law, while also considering the limitations of the court’s jurisdiction in light of the ongoing conflict.

In addition to the ICC, the study explores the role of other international mechanisms, such as the European Court of Human Rights (ECHR) and the United Nations Human Rights Council, in addressing human rights violations and war crimes in Ukraine. These bodies have been instrumental in documenting abuses and providing legal recourse for victims, but their ability to enforce rulings in the context of an active conflict remains limited. The study appraises the effectiveness of these institutions in complementing the efforts of the ICC and Ukrainian courts.

Furthermore, the research examines the involvement of non-state actors, including separatist groups and foreign fighters, in the conflict. The jurisdictional issues surrounding the prosecution of these actors, particularly in areas outside the control of the Ukrainian government, pose significant challenges. The study explores the potential for international cooperation in extraditing suspects and ensuring that justice is served for all parties involved in the conflict.

The study concludes by offering recommendations for strengthening the criminal justice framework in Ukraine. These include enhancing international cooperation, increasing support for the ICC’s investigations, and bolstering the capacity of Ukrainian courts to handle complex war crimes cases. The research emphasizes the importance of a coordinated approach that combines national and international efforts to ensure accountability for the grave crimes committed in Ukraine. This appraisal underscores that addressing the legal challenges in Ukraine is not only crucial for justice but also for the long-term peace and stability of the region.
