CHAPTER ONE

GENERAL INTRODUCTION

1.1 Background to the Study

The protection and promotion of human rights are fundamental principles that underpin democratic societies and the rule of law[1]. However, in the context of counterterrorism measures, striking a balance between national security imperatives and respecting human rights can be a complex and delicate task. This research project aims to explore and address the issue of human rights violations in the context of counterterrorism measures in Cameroon.

Cameroon, like many other countries, has faced significant security challenges posed by terrorist groups operating within its borders. In response, the government has implemented various counterterrorism measures to ensure the safety and security of its citizens. However, there have been concerns and reports of human rights violations occurring as a result of these measures, including arbitrary arrests, torture, extrajudicial killings, and restrictions on freedom of expression and assembly.

The objective of this research project is to critically examine the nature and extent of human rights violations in the context of counterterrorism measures in Cameroon. It seeks to identify the root causes, patterns, and systemic factors that contribute to these violations. Additionally, the project aims to assess the impact of these violations on the affected individuals, communities, and the overall human rights situation in the country.

Furthermore, this research project will analyze the legal and policy framework governing counterterrorism measures in Cameroon, including the relevant international human rights standards and obligations[2]. It will assess the adequacy and effectiveness of existing mechanisms for accountability, redress, and oversight in addressing human rights violations committed in the name of counterterrorism.

The findings of this research project will contribute to a better understanding of the challenges and complexities involved in balancing counterterrorism efforts with the protection of human rights. The ultimate goal is to provide evidence-based recommendations and strategies to address human rights violations in the context of counterterrorism measures in Cameroon. These recommendations can be utilized by policymakers, civil society organizations, and international stakeholders to promote human rights compliance, accountability, and the rule of law in the fight against terrorism.

By shedding light on this important issue, this research project seeks to contribute to the development of a comprehensive and rights-based approach to counterterrorism that upholds human rights, strengthens security, and fosters sustainable peace in Cameroon.

Cameroon has been grappling with the threat of terrorism for several years, particularly in the northern regions and in the southern Cameroon[3], the Boko haram activities that started in 2013 and the Anglophone crisis which began in 2016 of which the problems remained unsolved. In response, the government has implemented various counterterrorism measures to ensure the safety and security of its citizens. However, there have been widespread concerns about human rights violations occurring in the context of these measures. This research project aims to investigate and address the human rights violations associated with counterterrorism efforts in Cameroon.

Cameroon, located in Central Africa, has been facing a significant challenge in the form of terrorism, particularly in its northern regions[4]. The rise of extremist groups, such as Boko Haram and the Islamic State West Africa Province (ISWAP), and the Ambazonian crisis in the southwest region of the country Cameroon, has posed a serious threat to the country’s stability and security. In response to this threat, the Cameroonian government has implemented various counterterrorism measures to protect its citizens and combat the activities of these terrorist organizations[5].

While the government’s efforts to counter terrorism are crucial for safeguarding the nation, there have been growing concerns about the potential human rights violations occurring in the process. Human rights organizations and activists have raised alarms about alleged abuses committed by security forces during counterterrorism operations. These violations include extrajudicial killings, arbitrary arrests and detentions, torture, forced disappearances, and infringements on freedom of expression and assembly.[6]

1.2 Statement of the Research Problem

The research problem on addressing human rights violations in the context of counterterrorism measures in Cameroon revolves around the examination of how the implementation of counterterrorism strategies impacts human rights in the country. This study aims to investigate the specific human rights violations that occur as a result of counterterrorism efforts in Cameroon, analyzing the legal frameworks, policies, and practices that contribute to or mitigate these violations. Furthermore, it seeks to explore the challenges faced by individuals, communities, and civil society organizations in seeking accountability for human rights abuses committed under the guise of counterterrorism, with a focus on identifying potential solutions and recommendations to uphold human rights while effectively combating terrorism.

How can human rights violations in the context of counterterrorism measures in Cameroon be effectively addressed to ensure the protection of fundamental rights and freedoms of individuals while maintaining national security?

• What are the means of fighting against terrorism in Cameroon?
• What are the challenges faced in countering terrorism in Cameroon?
• What policy recommendations can be make?
