ABSTRACT

The Dispute Settlement Body (DSB) of the World Trade Organization (WTO) is a crucial mechanism for resolving trade disputes between member states, ensuring compliance with international trade agreements and promoting a rules-based trading system. This study analyzes the structure, functions, and effectiveness of the DSB, highlighting its role in maintaining global trade stability. The research begins by outlining the legal framework governing the DSB, established under the WTO Agreement, and examines its procedural rules and mechanisms for resolving disputes.

The study details the process of dispute resolution, starting from consultations between parties, followed by the establishment of panels, and culminating in the Appellate Body’s review of panel reports. It emphasizes the importance of timely and impartial adjudication in maintaining the integrity of the multilateral trading system. Key features of the DSB, such as the automaticity of the dispute resolution process and the requirement for members to comply with rulings, are critically assessed to understand their implications for member states.

Through an examination of case studies, this study highlights notable disputes that have shaped the DSB’s jurisprudence, including landmark cases involving trade remedies, subsidies, and intellectual property rights. These cases demonstrate how the DSB has addressed complex issues and the role of its rulings in clarifying WTO rules. The analysis reveals both the strengths and weaknesses of the DSB, particularly in terms of its ability to enforce compliance and the challenges posed by political pressures among member states.
