Abstract
This study appraises the role of the International Court of Justice (ICJ) in the settlement of interstate disputes, using the Israel-Palestine conflict as a case study. The ICJ, as the principal judicial organ of the United Nations, plays a crucial role in resolving disputes between states and providing advisory opinions on international legal questions. This research evaluates the effectiveness and limitations of the ICJ in addressing one of the most protracted and complex conflicts in modern history.
The study begins by outlining the mandate and jurisdiction of the ICJ, including its role in settling legal disputes submitted by states and issuing advisory opinions on legal questions referred by international organs and agencies. It provides an overview of the ICJ’s procedural mechanisms, such as the submission of written and oral arguments, and the issuance of binding judgments and advisory opinions.
The research then focuses on the Israel-Palestine conflict, a longstanding dispute with deep historical, political, and legal dimensions. The study explores key legal issues central to the conflict, including questions of sovereignty, territorial integrity, and human rights. It assesses the extent to which the ICJ has been involved in the conflict, examining relevant cases and advisory opinions issued by the Court, and analyzing the impact of these decisions on the conflict’s resolution.
One significant aspect of the appraisal is the ICJ’s involvement in specific cases related to the Israel-Palestine conflict.
