Abstract

This study assesses the powers of the administrative judge in Cameroon, focusing on the role and scope of administrative judicial authority within the country’s legal system. The administrative judge is a crucial component of the judiciary, responsible for overseeing disputes between individuals and public authorities, ensuring the legality of administrative actions, and protecting the rights of citizens in the context of administrative law.

The research begins by outlining the structure and function of the administrative judiciary in Cameroon, highlighting its establishment under the legal framework of the country’s administrative justice system. The study examines the historical evolution of administrative justice in Cameroon, from the colonial period to the present day, noting key reforms and the development of administrative judicial principles.

The core of the study focuses on the powers and jurisdiction of the administrative judge in Cameroon. This includes an in-depth analysis of the administrative judge’s authority to review administrative acts, such as decisions and regulations issued by public authorities. The research explores the scope of this review power, including the grounds on which administrative acts can be challenged, such as legality, fairness, and adherence to procedural requirements.

The study also addresses the administrative judge’s role in protecting individual rights and ensuring accountability within the public administration. It examines how the administrative judiciary handles cases involving allegations of abuse of power, administrative errors, and violations of fundamental rights. The research highlights the procedural mechanisms available to parties seeking redress, including the filing of complaints, the conduct of hearings, and the issuance of judicial decisions.

Additionally, the research assesses the effectiveness and limitations of the administrative judge’s powers. It discusses the challenges faced by the administrative judiciary in Cameroon, such as issues related to judicial independence, the capacity of administrative courts, and the implementation of judicial decisions. The study also considers the impact of these challenges on the quality and accessibility of administrative justice for citizens.

In exploring the broader context of administrative justice, the research examines comparative perspectives, including the role of administrative judges in other jurisdictions. This comparative analysis provides insights into best practices and potential areas for reform in Cameroon’s administrative justice system.

The study concludes with recommendations for enhancing the effectiveness of the administrative judiciary in Cameroon. These recommendations include strengthening the legal framework governing administrative justice, improving the training and resources available to administrative judges, and fostering greater public awareness of administrative judicial processes. The research emphasizes the importance of ensuring that administrative justice remains a robust and accessible mechanism for upholding the rule of law and protecting individual rights in the face of administrative actions.
