Abstract
This study provides a legal appraisal of climate change adaptation and mitigation strategies within the context of the patent paradigm in the African Intellectual Property Organisation (OAPI) sub-region. Climate change is a critical issue affecting Africa, necessitating both adaptation and mitigation strategies to minimize its adverse impacts. The role of intellectual property, particularly patents, in facilitating innovation for climate solutions is increasingly recognized. In the OAPI sub-region, the intersection of climate change law and intellectual property law presents unique challenges and opportunities for fostering climate-resilient technologies.
This research adopts a doctrinal approach, analyzing the legal frameworks governing patents and climate change within OAPI member states. It examines how existing patent laws impact the development, transfer, and diffusion of climate technologies essential for adaptation and mitigation. The study also explores international legal instruments, such as the Paris Agreement, and how they influence patent regimes and technology access in OAPI countries.
Findings suggest that while OAPI’s patent system plays a role in protecting innovations related to climate change, there are significant barriers to accessing and utilizing patented technologies for climate adaptation and mitigation. These barriers include high costs, limited local innovation capacity, and restrictive patent laws that may inhibit technology transfer to developing countries. Furthermore, the study highlights the need for OAPI member states to align their patent regimes with international climate change commitments, fostering greater access to green technologies.
The study concludes that legal reforms within the OAPI sub-region are crucial to enhancing the role of patents in supporting climate change adaptation and mitigation. Recommendations include adopting flexibilities within the patent system, promoting collaborative innovation, and ensuring that patent laws do not hinder the development and dissemination of climate-resilient technologies. Strengthening the legal framework for technology transfer and capacity building is also essential for addressing the region’s climate challenges.
