1 Introduction

 Murder can be defined as the intentional and unlawful killing of another person. Murder is a grave offence that is universally condemned due to its irreversible consequences and violation of the fundamental rights to life. It is therefore a heinous crime that strikes at the core of societal values and infringes upon all fundamental rights to live. In Cameroon, murder is a criminal offence that is governed by the provisions of the penal code in its section 275&276 which is punishable by life imprisonment or death respectively. They’re different ways by which the court can hold one responsible for the death of another and when taken into consideration by the court, the court can the pass their judgment. For either section 275 or 276 to apply it is necessary for the prosecution to prove that the act of killing amounts to murder when that is done and only then with the accused reliable to life imprisonment under section 275 or by death under section 276 of the CPC

Penalties: the penalties of murder under The Cameroon penal code as severe the penalty for murder is generally life imprisonment or the death sentence. However in practice the death penalty is really carried out and the life imprisonment is a more common sentence as presentation 275 of the CPC. The court has the discretion to determine the most appropriate penalty in the circumstances of each case.

 They’re three main elements of murder which include:

1.2.1 ACTUS REUS

The actus Reus of murder in Cameroon entails an unlawful and intentional act or omission that causes the death of another. According to section 276 of the CPC, murder is committed when an individual unlawfully causes the death of another. The actus Reus encompasses a broad range of actions such as, the use of lethal weapons, physical assault or any intentional act that directly leads to the death of another. The physical element is sub-divided into two Act (conduct) and death (consequence).

For instance, if A in some circumstances had the ability to assist B but refrain from doing so, it can amount to the physical element.

OMISSION: Generally, the law only punish those who caused a prohibited result by a positive act but it came to accept that it should also punish those who fail to act when a duty to act could be implied with the fact that the prohibited result is ensured. However, the position is that there is still no general duty to act. The may well be a moral obligation to help someone but the is not a legal one. The legal imposition is that the offender must have had the legal role to act recognized by law.[1]

 1.2.2 MENS REA

Mens really refers to the mental element or the guilty mind of the offender. In the context of murder, it involves the Intention or knowledge to cause the death of another. The penal code recognizes different forms of mens rea on relation to murder.   For instance, intentional murder occurs when a person commits a deliberate and remediated intention to cause the death of the victim.

Additionally, murder can be established when an individual act with direct intent specifically aiming at causes the death of the victim. See the case of the people v. Nchindia Isaac (2004) and the case of Usumamu v. The people. Under this, they’re elements that may aggravate it.

Furthermore, murder can also be proven when an individual exhibits a reckless disregard for human life displaying a gross negligence that leads to fatal consequences.

However, generally, the physical element alone cannot constitute the offence of murder.

Direct intention: where the offender desires an outcome e.g. a psychopath who enjoys torturing and killing people seeking the case of Byrne (1960).[2]

Oblique intention: as indicated above, indirect or oblique intention occurs where D does not necessarily desires an outcome but realizes that it almost (but not quite) inevitable. However, this scenario invites problems. What degree of probability is required before an undesired consequence, but one which D has foreseen, can be said to have been intended? Some would argue none that once one step away from four side of something as 100% certain to happen then one is dealing with risk and that means recklessness not intend. A good place to start an examination of intent is the criminal justice act of 1967 which states that a court or jewelry in determining whether a person has committed and offense

A) should not be bound in law to infer that he intended all foresee The result of his actions by reason only of it being a natural and probable consequence of those actions but

B) Shall decide whether he did intend or foresee that result by reference to all the evidence drawing such inferences from the facts as appear proper in the circumstances.[3]

1.3 THE RESULTS

The consequences of murder under the cameroon one penal code AS several and affect the gravity of the offense. Murder is classified as a felony and upon conviction the offender may face life imprisonment as per section 275 of the CPC or the death penalty as per section 276 of the CPC depending on the circumstances surrounding the crime such as,

Premeditation: if the murder was premeditated or planned in advance it may be considered aggravating factors potentially leading to a more severe penalty.

Motive: the motor behind the murder may be taken into account during the trial and sentence in the phrase factors such as financial gain revenge or other malicious intent may impact the severity of the punishment.

Mitigating circumstances: on the other hand certain factors may be considered me to getting circumstances which could result in lesser punishments. This may include provocations self-defense factors that may reduce the moral capability of the accused. The punishment for murder serves as a deterrence and emphasize the societal condemnation of such acts aiming to protect the sun city of life and provide justice for the victims and their families. Under actus reviews there are elements which are subdivided into two acts (conduct) and death (consequence) and act part being for example A points a gun at B and pulling the trigger etc. while the consequence with A’s action is the death of B. [4]

1.4 CONCLUSION
