ABSTRACT

Non-profit organizations (NPOs) play a crucial role in Cameroon’s social and economic development, addressing a wide range of issues such as poverty alleviation, healthcare, education, and environmental protection. However, the regulatory framework governing these organizations has been a subject of ongoing debate and scrutiny.

This study aims to examine the key regulatory principles that guide the operations of NGOs in Cameroon. Using a qualitative research approach, the study analyzes the relevant laws, policies, and institutional frameworks that shape the non-profit sector in the country.

The findings reveal that the regulatory principles governing NGOs in Cameroon are centered around three main pillars: registration and incorporation, financial management and reporting, and governance and accountability. The study highlights the challenges and limitations within the current regulatory environment, such as the bureaucratic hurdles in the registration process, the lack of clear financial reporting guidelines, and the limited oversight mechanisms to ensure transparent and ethical operations.

 To add this study concludes by proposing a set of recommendations to strengthen the regulatory framework and promote the effective and accountable management of NGOs in Cameroon. These include streamlining the registration process, enhancing financial transparency requirements, and establishing robust monitoring and evaluation systems. The findings of this study can inform policymakers, civil society organizations, and other stakeholders in their efforts to foster a more enabling environment for the non-profit sector in Cameroon.

CHAPTER ONE

 GENERAL INTRODUCTION

1.1 Background to The Study

A non-profit organizations, also known as a not-for-profit organization, is a type of entity that operates for purposes other than making a profits. These organizations are typically dedicated to serving the public interest or furthering a particular social cause. Non-profit organizations can take various forms, including charities, foundations, advocacy groups, religious institutions, and educational institutions. They rely on donations, grants, and other sources of funding to support their activities and achieve their mission.[1]

Non-profit organizations play a significant role in society by providing services and support to various groups and communities. These organizations serve a wide range of purposes, from addressing social issues to promoting the arts and culture. In order to ensure that non-profit organizations operate effectively and ethically, they are subject to regulatory principles that guide their activities and governance. This essay will provide a background study on the regulatory principle of non-profit organizations, examining the importance of regulation, the challenges faced by non-profits, and the key regulatory principles that govern their operations.

Regulation is crucial for non-profit organizations to ensure accountability, transparency, and ethical behavior. As non-profits rely on donations and funding from various sources, it is essential to maintain the trust of donors and stakeholders by demonstrating good governance practices. Regulation helps to protect the interests of stakeholders, prevent fraud and abuse, and uphold the mission and values of the organization. In addition, regulation can help non-profits to improve their operations, enhance their impact, and achieve their goals more effectively[2]

Non-profit organizations face a range of challenges that can make it difficult to comply with regulatory requirements. These challenges include limited resources, competing demands, and complex regulatory frameworks. Non-profits often operate on tight budgets and rely on volunteers and donations to support their activities, which can make it challenging to invest in compliance and governance practices. In addition, non-profits may face pressure from funders and stakeholders to achieve specific outcomes, which can create conflicts of interest and ethical dilemmas. Furthermore, the regulatory environment for non-profits is constantly evolving, with new laws and regulations being introduced that can be difficult to navigate.[3]For examples  LUKMEF also know as Matin Luther king JR memorial foundation .it is an NGO working to promote peace, social justice and sunstainable development in Cameroon since 1991 empowering communities to lead their environment. Their main priority is to improve on the welfare of the society and by so doing they get their finances from Interpretation donors.

There are several key regulatory principles that govern the operations of non-profit organizations, including the following:

  1. Mission and Purpose: Non-profits must have a clear mission and purpose that guides their activities and ensures alignment with their charitable objectives. Organizations should demonstrate how they are fulfilling their mission through their programs and services.
  2. Governance and Oversight: Non-profits are required to have a board of directors or trustees that provides oversight and direction for the organization. The board is responsible for setting strategic priorities, monitoring financial performance, and ensuring compliance with legal and regulatory requirements.

1.2 Statement of The Problem

One of the main problems with the regulatory principle of non-profit organizations in Cameroon is the lack of clarity and consistency in the regulatory framework. The regulations governing non-profit organizations are often vague and ambiguous this is because: Non-profit regulations can vary across different jurisdictions, such as countries, states, or provinces. These regulations may change over time as new laws are enacted or existing laws are amended. The evolving nature of the legal landscape can contribute to ambiguity, as organizations and regulators may need to adapt to new requirements and interpretations making it difficult for organizations to understand their obligations and comply with the law. This lack of clarity leads to confusion and uncertainty among non-profit organizations, as they struggle to navigate the complex regulatory landscape.[4]

Another major issue is the lack of transparency and accountability in the regulatory process. Non-profit organizations are required to submit various reports and documents to regulatory authorities, but there is often a lack of oversight and monitoring to ensure that organizations are complying with the law. This lack of accountability creates opportunities for corruption and mismanagement within non-profit organizations, undermining their effectiveness and credibility.

This problems makes it difficult for non profit organization to operate effectively and to meet their mission of serving the public good.

1.4 RESEARCH OBJECTIVE

To analyze the effectiveness of existing regulatory framework for non-profit organization in Cameroon and identify areas for improvement to enhance transparency,  accountability and efficiency in their operations.?
