ABSTRACT

The role of law in promoting general safety on flights under international law is critical to ensuring the safe and secure operation of international civil aviation. This study appraises the international legal frameworks, conventions, and regulatory bodies that govern flight safety, with a focus on their evolution, implementation, and challenges. The legal regimes that provide oversight, promote uniform standards, and address emerging threats to flight safety are examined to assess their effectiveness in reducing risks and enhancing global aviation safety.

The study begins by outlining the key international legal instruments that form the foundation for flight safety under international law. Central to this framework is the Chicago Convention on International Civil Aviation (1944), which establishes fundamental principles for the safe and orderly development of international air travel. The study explores how the International Civil Aviation Organization (ICAO), created under this convention, plays a leading role in setting global standards for aviation safety, security, and environmental protection.

The analysis highlights the importance of ICAO’s Annexes to the Chicago Convention, particularly Annex 13 (Aircraft Accident and Incident Investigation) and Annex 19 (Safety Management). These instruments provide detailed regulations on safety management systems (SMS), accident reporting, and risk mitigation strategies that help ensure the highest level of safety in global aviation. Additionally, ICAO’s Universal Safety Oversight Audit Programme (USOAP) is examined as a tool for monitoring and ensuring compliance with international safety standards by member states.

The study also considers other significant legal frameworks that contribute to flight safety. These include the Tokyo Convention (1963) on offenses and certain other acts committed on board aircraft, which addresses unlawful acts threatening flight safety, and the Montreal Convention (1999), which deals with airline liability in cases of accidents. Furthermore, the study evaluates the role of bilateral and multilateral agreements, such as Open Skies agreements, in regulating air transport safety.

Challenges in enforcing flight safety regulations are discussed, including variations in national implementation of international standards, technological advancements, and emerging security threats like cyber-attacks and terrorism. The study emphasizes the need for stronger collaboration between states, regional organizations, and aviation stakeholders to address these issues and ensure consistent safety standards across borders.

In conclusion, the role of international law in promoting flight safety is indispensable to the safe operation of global aviation. While international legal frameworks have significantly improved flight safety, continued advancements in technology, regulatory cooperation, and compliance enforcement are essential to address evolving risks and enhance overall safety in the international aviation sector.
