ABSTRACT

The resolution of disputes in international law is a complex process often requiring the involvement of both global and regional organizations. This study examines the role of the United Nations (UN) and regional organizations in resolving conflicts, using the Democratic Republic of the Congo (DRC) as a case study. By analyzing the strategies employed by these organizations, the research highlights their effectiveness, challenges, and the dynamics of conflict resolution in the context of the DRC.

The study begins by providing an overview of the historical context of conflicts in the DRC, emphasizing the multi-faceted nature of the crises that have plagued the country since the late 1990s. The involvement of external actors and regional tensions, particularly in Central Africa, are essential to understanding the complex landscape of conflict resolution.

The role of the UN, particularly through the United Nations Organization Stabilization Mission in the Democratic Republic of the Congo (MONUSCO), is critically analyzed. Established in 2010, MONUSCO has been tasked with protecting civilians, supporting the government in stabilization efforts, and facilitating humanitarian assistance. The effectiveness of MONUSCO’s operations, including its challenges in addressing violence and human rights abuses, is assessed through specific case studies of interventions.

Additionally, the study explores the contributions of regional organizations, such as the African Union (AU) and the Southern African Development Community (SADC). These organizations have played significant roles in peace negotiations and regional diplomacy aimed at resolving disputes in the DRC. The research highlights key initiatives, including the Peace, Security, and Cooperation Framework for the DRC and the region, emphasizing the importance of regional ownership in conflict resolution processes.

The study also addresses the challenges faced by both the UN and regional organizations, including issues of coordination, funding, and political will among member states. The dynamics of sovereignty and non-interference further complicate efforts to resolve disputes, raising questions about the limits of external intervention.

In conclusion, this appraisal underscores the crucial roles of the UN and regional organizations in resolving disputes in international law, particularly in the DRC. While significant progress has been made, ongoing challenges necessitate a more integrated approach that combines global and regional efforts. Strengthening partnerships, enhancing local capacities, and fostering inclusive dialogue are essential for achieving sustainable peace and stability in the region.
